Terms & Conditions

1. Who you are contracting with
Clue Quest is operated by David Forward, a sole trader (ABN 63 688 014 837), trading as Clue Quest (“Clue Quest”, “we”, “us”). We provide this website and the printable treasure hunt packs sold through it. When you create an account or buy a pack, you are entering into an agreement with David Forward, trading as Clue Quest.
2. Acceptance
By creating an account, buying a pack, or continuing to use the service, you agree to these terms. If you do not agree, please stop using the service. If you are buying on behalf of an organisation, you confirm you have authority to bind it; if you are buying as an individual, you confirm you are of legal age to do so.
3. What we provide
You upload photographs of places in or around your home. We produce illustrated clue artwork from those photographs and assemble a printable pack containing clue cards and a parent guide. The pack is delivered digitally through your account.
4. Your account
You are responsible for keeping your login details confidential and for activity that happens under your account. Please give us accurate information and keep it up to date.
5. Acceptable use
You must not misuse the service. In particular you must not use it unlawfully, for fraud or spam, to infringe anyone’s intellectual property, or to interfere with its security (for example malware, probing, or scraping). You must not reverse engineer the service, resell or redistribute it, or circumvent technical limits.
6. Photographs, prompts and generated artwork
Our artwork is produced with the help of generative AI.
- You are responsible for the photographs and any text you supply, and you confirm you have the rights to use them. Please do not upload content you do not own or have permission to use.
- You must not use the service to create illegal content, deepfakes or impersonations, hateful or sexual content involving minors, malware, or to attempt to bypass our safety controls.
- You keep the rights in the photographs you upload. Subject to payment, you may use the generated artwork and pack for your own personal, non-commercial family use.
- Generated artwork is an interpretation, not a faithful reproduction, and may be inaccurate or imperfect. It is not suitable for any regulated or professional purpose.
- We may refuse, filter, remove or restrict content and outputs, and may suspend accounts that break these rules. If you believe content infringes your rights, contact us and we will review and remove it where appropriate; repeat infringers lose access.
7. Our intellectual property
We retain ownership of the service itself, including its software, templates, designs, documentation and branding. Nothing in these terms transfers that ownership to you. You receive a limited, non-exclusive, non-transferable right to use the service and your pack.
8. Service level
We work to keep the service available and working well, but we cannot guarantee it will be uninterrupted, timely or error-free. To the fullest extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose. Nothing here limits rights you have under the Australian Consumer Law or other laws that cannot be excluded.
9. Payment, billing and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. Our own refund commitment is set out in our Refund Policy.
10. Suspension and termination
We may suspend or end your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. If your access ends, you may ask us for a copy of your packs within 30 days, after which your data may be deleted.
11. Liability
To the extent permitted by law, we are not liable for indirect, consequential or special loss, including loss of profits, data or goodwill, and our total liability is limited to the fees you paid in the 12 months before the claim. We do not exclude liability for fraud, death or personal injury where the law does not allow it.
12. Indemnity
You agree to cover claims arising from the content you upload, your unlawful use of the service, or your breach of these terms.
13. General
These terms are governed by the laws of Victoria, Australia, and disputes are subject to the courts of that jurisdiction. You may not assign these terms without our consent; we may assign them as part of a merger or sale of our business. Neither party is responsible for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here.
14. Contact
Questions about these terms can be sent to hello@cluequesthunts.com, or to Paddle for anything relating to a payment or refund.
